My Marine was reccomended for separation for backdated depression - diagnosed one year in. Being accused of fraud for not telling the recruiter but he never had a diagnosis before and didn't think he was depressed.

What kind of evidence is needed to backdate? Any chance it could be a medical discharge? He doesn't want out, only wants to serve.

Are you saying he's being discharged for failure to disclose a mental health condition when he initially enlisted?

Yes. Thing is, he was never evaluated by a doctor, never diagnosed, never prescribed anything and didn't think he was even depressed. So, is that really failure to disclose?

They are basing the discharge based on something, they just don't say "hey, we think you used to be depressed and didn't tell us when you enlisted." He has either told them he had been treated for depression and failed to disclose it during the enlistment process, or they have some other documentation or proof.

Who are you in this situation?

Did he previously take any medications FOR OTHER CONDITIONS, but that are classified under the "anti-depressant" umbrella? And if so, did he disclose those medications to his recruiter?
