Millitary convictions


Is it true that if a person has a millitary conviction that the only people who can legally recive that information is goverment agencys?

How does it work?

It depends on the situation, and the actual workings can be fairly complicated -- depending on what type of conviction, what the underlying crime is, etc. etc.
For example, a person might be required by a military conviction to register in their state as a sex offender, with different state-by-state rules as to what information is made public. You may be on an internet databases for everyone to see, or you may be on a more 'restricted' database that potential employers and police get to see, etc. etc.

Tell what type of court convicted you, what the charges were, and what the sentence was. Maybe we can give you a better idea.

I was sentanced in millitary court in general for larceny housebreaking and desertion.
i was sentanced to 48 months confinement and reduction from e-5 to e-1 and forfiture of pay and allowances

I am a bit surprised that you were not also given a Bad Conduct
or Dishonorable discharge with this type of sentence. You have a
federal (which is construed a felony) conviction. So, on the vast
majority of applications, you will run into questions such as: Have
you have been arrested; have you ever been convicted of a felony
or a misdemeanor, etc. And, if you lie about this, and eventually
will be found out, then this also will be entered into your employment
history record[s]!

BOP won't list a military prisoner unless he or she was transferred to federal BOP custody. Military correctional prisoners are not listed.

The real question is whether or not this guy is listed in NCIC. Most military convictions (summary excluded and occasionally special CM's where the accused was not rep'd by counsel) are listed in NCIC.

Since he has a general CM, its a good bet he's listed in NCIC.
