my daughter


What is the name of your state? missouri

My daughter who just turned 17 two weeks ago is pregnant by a 20 year old male who is in the army. she was 16 when they had sex. He was told that they could not have sex because birthcontrol did not work for her. His father told a fellow police officer that his son did it on purpose so we would let them get married. They have only been dating 2-2 1/2 months. This young man has told me that my daughter will do what his says or else and that if she tries to leave him he will stop her. I know that he told me that he is bi-polar, and that the army does not know. he also says that he can't wait to go to Iraq so he can kill people. I was told from someone at the army base that in the eyes of the army my daughter is a minor and that we can possibly prosecute him. Is this true? or was this person wrong. Please help!

The Statutory Rape Laws say the he would have to be 21 and older to be charged. But there are other things you can do! Get a restraining order against him. Also talk to an attorney and see what other steps you can take to keep this guy away from your daughter.

How do you know that BC doesn't work for your daughter? Has she gotten pregnant before while on it?

Also have a talk with his CO and explain the situation to him....I doubt the Military will be happy with there GI Joe's impregnating little girls!

I'm not 100% sure but I think 16 years of age is the legal age limit in the Army for sex.

Is not the Law in Missouri for consensual sex 14? Or is that
just the age requirement to legally get married?

Missouri

§ 566. 032 (1)

§ 566. 034 (1)
First-degree statutory rape to have sexual intercourse with another person who is less than fourteen years old.

Five years to life in prison

Second-degree statutory rape for someone at least age 21 to have sexual intercourse with someone who is less than age 17


Up to seven years in prison

Throughout the UCMJ, a "minor" or a "child" is defined as being under 16 years of age. Thus, under the UCMJ he could not be charged with any crime where an element was that the conduct be with a minor. I'm not certain what the state law is.

The post dodged the big question: How does the daughter feel about this? She is in a much better position to take legal action, be it a restraining order or eventually getting child support, than the parents are. If she is dead set on getting married....

Fozzy....You are so wrong! She is SEVENTEEN! A MINOR! She does not get to decide until she is a legal adult! The OP has some fruitcake that deliberately impregnates his daughter and you think that the minor daughter gets to decide what to do?? NO WAY!

Don't take this personally...I like you and generally you give great advice...but on this one you are way off...

Yes he does give great advice and he is not wrong. Read 920 ART. 120 of the UCMJ
