Narcolepsy Vs. Article86 #2


What is the name of your state?Virginia
Well it happened again I was late this morning. Still getting upsetting news from my chain of command. I beleive they are rewriting the article 15 because I have been late 3 times since they submitted it to Group Legal.
Should I tell my command anything other than a request for special court martial when they read the article 15 to me? Who would be the prosecutor in this event, would it be someone from my command or an outside individual? I cannot deny the facts that I have been late, an average of 2 times a week since September 04, but I havn't missed movement. What other charges do you think they could tack onto my case? Everyone is tight lipped, I wouldnt even have known about the Article 15 if it wasnt for a close friend of mine (Legal NCO) at my unit. Every day that goes by I am greeted with hostility from my seniors, should this be something I bring up? BadApple, thanks for your words, I will definatly adhere to them.

AWOL requires a voluntary action -- all military criminal law requires that you have the ability to conform to standards/regulations. Here you could not for voluntary reasons. What does the ADC tell you about the situation?

BA did you mean involuntary? Narcolepsy is not a voluntary act, one has to wake to take the medication and then it takes a while to work.
