What is the name of your state? Florida (But im in baghdad now)

im currently being charged with a negligent discharge of a weapon system. My entire lower chain of command is saying it wasent my fault and i was cleared in a 15-6 investigation. But my battalion level command is wanting to push the issue to a field grade art. 15. Im not willing to eat the punishment if it wasent my fault and was wondering a few things on court martials. How much sway is past brush ins with trouble going to have in the outcome of a special court martial ? its nothing major but a few negative counseling statements do exist.

It seems very odd that your lower chain of Command is basically supporting you, and that, you were cleared in the 15-6 investigation;
and now, your upper Command is wanting to push for an Article 15. By the way, an Article 15 can be appealed if called for.

Per chance, did the accidental discharge of a weapon's system cause any bodily harm or property damage?

Were you not represented by a JAG Officer in your 15-6; and why are you not speaking with a JAG Officer about your present dilemma?
There are always two sides to a fence unless the fence is against something that obstructs it from being so.

It is to early to go into all the details, and aspects of a Court[s] Martial etc.

You'll have to talk to a Trial Defense lawyer if your commander tries to give you an Article 15. If the case has no merit, he may tell you to go back to your unit and refuse the Article 15. There are limited situations where you can be FORCED to take non-judicial punishment, but if Trial Defense thinks they have no case, then you probably won't be facing a court-martial.
