Need help!!


What is the name of your state (only U.S. law)? Louisiana

My BF is an E6 in the Navy with about 1.5 till retirement at 20 yrs. He was arrested for DUI after he was involved in a collision where some teenie boppers hit him. Things were OK till he was asked to submit to breath testing. He blew a 0.9 per his statment. He was arrested and spent the night in jail. Now what happens to his career? Things I have read to this point have been totally scary. He totaled his friends vehicle and was hurt. I am worried...help! FozzY?? can you advise?

It depends on his command honestly. He can just get into trouble and have restriction, extra duty, half months pay or they could discharge him. If he has a clean record then he would have a better chance of just getting into trouble rather than being discharged. If he has any other kind of alcohol incident this could prove to be bad on his behalf... and he would more than likely be separated. I'm no lawyer or anything this is based on what I've seen and heard. Hope this helps and good luck

You're worried about his career or him? Seriously, he needs to reconsider his future options. His career isn't at stake, depending who he is, he'll just slip by like nothing happen. Just a nice trouble with the law in his records. However if it's repeated problem his career may end. There are many ways the military can issue punishment. Ending his career is one of them, however that is not likely because of the offense isn't major.

I can say that even if they bust him down to E-1 over this, but let him finish out his 20 years, he will still retire as an E-6. It does depend on the Command though. But I just gave you the worst case scenario. I'm not saying that they even CAN bust him down to E-1 at this point. The first O-5 can bust him down 1 E grade, but no more.

I have seen a Navy E-7 get busted to E-1 at Fort Knox, KY. They let him finish his last year out and he retired as an E-7.

Provided he has over 18 years AFS, he will be afforded the opportunity to complete his career. He will most likely be busted to E-5, but he will retire as an E-6. He will still have to complete all the mandatory classes, etc required after a DUI and his on-base driving privileges will be revoked for a year (depending on the current Base Commander's policy in place), along with whatever civilian penalties apply.
