need some advice


What is the name of your state (only U.S. law)? Ohio

I have been awol for 3 weeks and I am trying to figure out what my options are as far as going back and getting a discharge. I just recently reported to my 1st duty station at the end of march 2009. I have medical records showing that I was diagnosed with migraines before I enlisted(which my recruiter had me lie about when I enlisted). I don't know if that will help or not. Any advice?

Turn yourself in right away.

If you say your recruiter told you to lie, they will investigate/talk to him. He will just deny it most likely. Before you decide what to do I recommend you figure out all your options and what you want as an outcome. My husband was denied a medical discharge because they told him he could take medications to correct his problems well enough to continue with his military duties. Such as lots of soldiers do. Some resources for helping you are GI Rights Hotline, Military Law Task Force, Peace and Justice Centers ( not everyone of these has trained personnel on this subject though ). Either way you will have to turn yourself in, it's just a matter of where and when. The military doesn't really want someone who's gone awol or doesn't want to be there, so don't let people scare you into thinking it's impossible to get a discharge- it probably just won't be the best discharge out there.....

That is the only accurate advice you have given yet. It doesn't matter if you have an army of liberal lawyers behind you, you will have to turn yourself in. You have passed the point of obtaining an honorable discharge. Your decision now will dictate whether or not you will have to see the inside of the brig. The best thing you can do for yourself is turn yourself in and face your lumps.

Which option is best for you depends on a lot of things. Turning yourself in right away is one option, but it has both positive and negative consequences and it may not be the option that is most likely to achieve your goal. I second BsBfrantic's suggestion that you make a call to get more information because the consequences of your actions at this point depend on a number of factors that are best discussed by phone.

Anyone who would second the advice of BsBfrantic is irresponsible and does not have the best interests of the OP in mind. The goal should be to stop violating the law as quickly as possible. Any advice to the contrary is a violation of Federal Law.
