NJP paper work submission


What is the name of your state (only U.S. law)? Virginia

On July 11, 2009 I went to Captains Mast and was awarded 45 days Restriction, 45 days extra duty, and reduction in rank from E-6 to E-5.
Well over the past couple of weeks I have asked our unit Yeoman about my Letters of Restriction, Extra Duty, and Reduction in Rank. So far every time the answer has been it is not submitted yet.
So here is the problem, I have gone through 2 pay periods, and approaching a 3rd where I am still recieving Base pay and BAH as an E-6. And the Command has still not submitted my paper work to our Servicing Personnel Unit, which means by the time the Command does submit my paper work the military will take 3 pay periods of the differance between E-6 and E-5 base pay and BAH from my paycheck, which will than result in my wife and i missing several bills due to their Deriliction of Duty, by not completing my paper work.

My question is, what options do i have to pursue my Command legaly? if any?

None, as an E-6 you should have figured out that the wheels of administration move very slowly. I would think that an E-6 would have known better then to spend the extra money you were paid in error. You lack of financial responsibility is not in any way the liability of anyone but you.

well to enlighten you, we have not spent the money that we were over paid becasue well we have not been overpaid yet, I by being responsible caught the problem prior to paycut for my service. Yes I said I caught the problem not anyone else, everyone else had ASSUMED that my paper work was submitted

I was not asking if someone in my command could be held responsible for me being over paid, insted i was asking if there is something that could be done for the lapse of judgement someone had in my command,

but by being the good former e-6 that i am i have done my own research and found an answer to the pay issue.

But thank you for your reply, as to it was of no use.

I'm glad your problem worked itself out.

But you said, "which will than result in my wife and i missing several bills." I don't understand how that can be possible if you have not spent the difference. Remember this is free advice, you get what you pay for.

As a former E-6, you should have known the answer to this one.

Under NJP, you have the right to appeal. You can submit the appeal within 5 days of the hearing, whether or not you demand appeal in the proceedings. Once the appeal is submitted, the higher Commander has another 5 days to make a ruling on the appeal.

You are underway or deployed, obviously. Your mast was on Saturday, 11 July. The outcome cannot be submitted for processing at DFAS until the completion of the 10 days following the NJP to prevent errors in the event a member is successful upon appeal. This means only AFTER 21 July can the paperwork move forward, or on 22 July at the earliest. We all know the following:

1. It takes longer for paperwork to move up the chain when forward-deployed.

2. DFAS cutoff date for EOM pay is on the 22nd of the month.



Your reduction will reflect on the 15 Aug mid-month LES at the earliest, and possibly on 1 Sep EOM pay, and that's playing by the rules.
