OTH for AWOL - Any Chance of an upgrade?


What is the name of your state? NY

I went AWOL in from the Army after 3 months (Just prior to graduating OSUT AIT )

I went AWOL because I told my Commander , Chaplain and JAG I made a mistake joining the Army, and requested an entry-level seperation and they would not give me one. This happened in 2004.

I was AWOL for 32 days, I went to Ft. Sill and I was processed and released in 4 days, I recieved my DD-214 a few months later.

My Questions is this, Can I upgrade this discharge to General "Under Honorable Conditions"?

How many of these AWOL discharges (if any) ever get upgraded? I never got locked up, never did drugs, never been in any trouble other than this, and I want to upgrade because I want to re-enlist when I finish my degree next year.

Any lawyers who specialize in this kinda stuff? Any help would be greatly appreciated.

Yes, there are plenty of Attorneys who specialize in Military Law and Justice;
you just need to search for one!

I would have to ask why you believe you deserve a discharge under honorable conditions. You did not serve honorably and failed to complete your term of service. I'm not picking on you, I'm asking a question that should be asked when you present your case.

I would answer that question by stating the truth, which to me would be: I joined the military at a bad time in life and was responsible enough to try to get out before things got bad, they would not let me, so i left. I now know the time is right and would like a second chance to serve my country honorably.

I believe that your chances of an upgrade are little to none. That said, I still think it is ok to try.

You _may_ want to wait until you've gotten your life back together, can demonstrate that you a fine upstanding citizen, volunteer at the local VA center, serve soup to the homeless, etc.

Our discussion would have divulged some personal details about myself, which I would choose not to put on a public forum.

I hate to beat a subject to death but...

To get your discharge upgraded you have to prove that it wasn't fair or it was in error.

The discharge you received probably meets the criteria of being fair and not in error.

Get your military records (there are plenty of threads that will tell you how). Pour over them you will need to look for reasons why it should have been a General instead of a OTH. Perhaps if you can outweigh your contributions to the military vs. your shortcomings (AWOL is a huge shortcoming) you may beable to pursuade them. Having an exemplary post military life will NOT be enough by itself, but it will help. Showing up at the hearing in person also helps if the opportunity is there.

Despite most thinking that these upgrades are impossible, they are not, but it takes a tremendous amount of work on your part to pursuade the board to change a discharge.

Lots of lawyers handle these upgrade applications. Generally they charge anywhere from $500 to $1000 or more if you want them to travel to DC. You can Google up there websites with keywords "Military Lawyers"

Now you said something about re-enlisting. I am sure your DD214 has a RE-4 re-enlistment code on it. You cannot re-enlist with that code. You will have to get it upgraded as well. Also not an easy task.

Going AWOL/UA has many consequences to it. I hope anyone reading this thread who is thinking about going AWOL/UA puts some serious thought into it first. There are other ways to deal with the military.

I just realized you were only in for 3 months. Duh... You may also try to have the discharged changed from OTH to Entry Level Seperation.

up grade


While you were at pcf and went trough jag then you should know that they said that even after yearsof discharge that it would probably take a letter from your church,gov,and state rep to get upgrade. the upgrade is more of a mythe than anything else. yet in mythe you can file for upgrade GOOD LUCK!!!!!!
