Reduction and Retirement


What is the name of your state (only U.S. law)? NC

I may be facing a Summary Court Martial and obviously, the possibility is there to be reduced from E-6 to E-5. I have 16 yrs TIS and my current EAS will take me to 56 days until I am eligible to retire, so I will have to extend.

My question is, if I was reduced to E-5, could I still retire in the Marine Corps?

On the flip side, if I faced a Special Court Martial and was reduced below E-5 (E-4, E-3), and did not receive a punitive discharge, could I still retire. It would stink for them to allow me to go to my EAS and then get kicked out with 56 days until I retire.

You will be forced out as high year tenure which I believe is 14 years for an E-5. You will get a severance check and no retirement benefits. You will still be eligible for VA benefits after a high year tenure discharge but not a BCD.

First, do not use acronynms. Second, what are the aleged charges?

TIS- Time in Service
EAS- End of Active Service
NC- North Carolina

It wqs a simple mistake with no intent ot defraud the Govt. Basically, I was paid twice for the same trip. I used a unit travel card to pay for my hotel room and I was also paid on my governemnt travel card for the same room.

As a note, if you are found guilty at your court martial you are likely to receive some sort of discharge. You can be sure it won't be an honorable one.
