I’m a national guardsman. I currently have over 20 years of service in the guard. In 2003, my guard unit was deployed to Iraq. I was injured in Iraq. I suffered a broken femur, fractured hip and knee problems. After many surgeries and long hours of physical therapy I’m still not completely recovered. I currently walk with the aide of a cane because my knee constantly gives out on me. While on active duty for about a year, recovering from my injury, I was given the option of being medically boarded or return to my guard unit (which was back from Iraq at the time). Being shy of 20 years by only a year, I didn’t want to through that away. So, I elected to return back to my unit with a permanent profile with certain restriction. I’m still seeking medical attention at the VA. The VA gave me a disability rating of 30%.
I was over looked for promotion to the next grade twice because of educational requirement and as a result, I’m being boarded out. I love the guard and would stay another 20 years if I could. I’m only 15 hours shy of getting my degree. I’m currently on Title 32 orders. My question is; can I request a medical retirement from active duty being that it’s Title 32 instead of being retired because I was passed over for promotion? And would the financial benefits be the same as if I had retired from Title 10? To my understanding, if PEB gives you a rating of 30% or more, you receive 50% of your base pay. And what procedures do I need to take in order to implement this. I’m looking down the road to see which will be more beneficial to me and my family. |
