Sailor's child custody in Japan

I am writing on behalf of my fiancee. He is currently over seas in Japan. He is in the Navy. He has been there for over 2 years now. He messed up and got a girl over there pregnant. The baby is almost one now. He is paying all he can for his son and loves him very much. The babies mom has recently been hanging up on my fiancee every time he tries to call. He is getting reasigned within a month and my fiancee wanted to see his son before he left. Since she keeps denying him we dont know what to do. we talked it over and we think the best thing would be to try for full costody of his son. I was wondering how it would work with him being in the Navy and his son being overseas? I was trying to look up all the stuff i could find to try to help him out. As of right now his babies mother is unwed and living with her mother and mothers bf i believe. Do you think he has a chance to get full custody concidering he is in the military? We plan on getting married and i would raise his son as my own child and am looking forward to it but what if he gets deployed would the courts take the child away because i am not the birth mother? This is really more of a custody issue than one of military law and you will probably get more responses on a group about custody/family law.

You left out a vital detail: Your fiancee is the father of a child. The mother has custody and she is "over there." But is she a U.S. citizen (and in the military?) or is she a citizen of Japan? I suspect the latter if she is living with her parents. If this is so, then you are facing a possible international child custody dispute. You will need to find a lawyer who handles such matters, the law in such situations (involving two nations family law) is usually very complicated.

thank you for your post back. i did post this message in the cutody forum to. i just didnt know which would be the right one to post it in. and yes she is from japan. she is a citizen of japan. i know there is very little hope that he will get his son but we are willing to fight. its kind of sad really most woman over there that have kids with the military are fighting for support and wanting the fathers in the kids life. mine wants his son to have a better life with us in the states. see in japan when a kid is born to an american and a japanease they are refered to as Amerasians. they have a very very difficult time in life. most that attend schools get so bullied they get depressed and drop out. i read some very horriable stories about that. i dont want his little boy to have to go through that. i know the courts in the states would think it would be best for him to be here but i know the courts in japan will deny my fiancee and say he is still better off in japan. i am just looking for any little bit of info that might help him in this case. i dont want the mother to kidnapped his son like i have heard alot of woman do in japan and the fathers never see there kids again. again any little help would be greatly appriecitated thank you !
