Trying to get back in the service and upgrade BCD

First a little history. This was roughly 15 years ago.

I was Honorably discharged from the MI National Guard to go active in the Marines.

I made it through their boot, because the Corps is the only service that if you want to get into you have to go through their boot. ( I know who would do that to themselves!)

During my time in my advanced schooling for the Corps. I got dropped back to another class, because I was young and stupid. During a test I put a couple of Instructors initals on my gunners exam. The Instructors said, "If anybody didn't make it through that day they would get dropped and me being prior service I had already known how to do everything that we were being tested on that day and I didn't want to see anyone in our platoon get dropped, because they didn't have time to get through, because they were wasting their time testing me.

Well when I turned my paper in I got caught and addmitted to it. I told my commander that I would take the test right now in front of him and prove myself, but he wouldn't let me. Darn the luck anyway I got dropped and the commander also told me I lost my duty station and my MOS.

I told the commander I wanted out then, because if I wanted to stay a grunt I would of stayed in the Guard.

During my time waiting for the next class to start I had talked to a legal platoon Sgt. and he said, "I could go UA and turn myself in and they would discharge me with an OTH. I went UA for a couple of weeks and turned myself in. Well, I be darn if they didn't put me back in training again.

I went UA for a second time and turned myself in once again. This time they put me in the Brig. for 75 days and a BCD. My lawyer told me I could get my BCD upgraded, so I sent all the paperwork to Washington or wherever it went and it was turned down.

I was told by an Army Reserve Recruiter, that because I have some kind of re-enlistment code on my DD214 that I couldn't re-enlist.

I am now trying to get into the Navy Reserve, because I see they are looking for EMTs. I did contact a recruiter yesterday, but no reply as of yet.

Any advice or any direction that anyone can give me would be greatly appreciated!

you probably have a re-4 reenlistment code on your dd214 wich means you are not recommended for reenlistment. While anyone can apply for a dishcharge upgrade they are not as easy as some tend think they are. You will have to really do your homework to prove that your discharge was unfair and the burdon of proof is totaly on you. You need to get copies of your military records to begin the process. This is not quick. You can do this yourself. The information on how is all over the web. You may want to retain a lawyer if this kind of tedious paper chase is not your cup of tea. You're recruiter may be able to help
