UA dilemma


What is the name of your state (only U.S. law)? Maine

The story: I forgot to check out on leave, then checked out 96 hours late. I am being charged 96 hours UA from the navy. I would like to know how to, or were to find info on UA policies or leave procedure's. Any help would be greatly appreciated.What is the name of your state (only U.S. law)?

Leave policies are generally different command to command. Look in your command policies or in the check in packets generally kept in the Admin office for any answers you may need. Bottom line, you screwed up bad.

Basically, the same thing happened to me some years ago. Leave ended on a Friday at midnight and forgot to turn in my leave papers and check in with staff duty officer. I was able to prove with airline paperwork that I had returned, but technically, it was still UA. Eventhough I was UA during liberty time. The charges probably wouldnt have been made, but they were attached to another violation that I was subsequently found not guilty of. I was found uilty of UA, but all punishment was suspended.

ART. 86. ABSENCE WITHOUT LEAVE
Any member of the armed forces who, without authority--
(1) fails to go to his appointed place of duty at the time prescribed;
(2) goes from that place; or
(3) absents himself or remains absent from his unit, organization, or place of duty at which he is required to be at the time prescribed; shall be punished as a court-martial may direct.

Upon an NJP/Captains Mast (which I assume you would receive), you should be given the opportunity to speak to legal counsel before proceedings who can provide you with defense strategies.
