Ucmj ?


What is the name of your state (only U.S. law)? TX, BUT I RESIDE IN WA STATE.

WHOM DO YOU PUSH UCMJ INVESTIGATION REGARDING A FEMALE SOLDIER THAT FOR TWO YEARS HAS HARASSED, STALKED ME AND MY CHILDREN AND PURSUED AFFAIR WITH MY EX SPOUSE DURING OUR MARRIAGE. I FORMERLY HAVE HAD A NO CONTACT ORDER AGAINST HER DUE TO HER STALKING MY FAMILY IN HER DESIRE FOR SEX WITH MY THAN HUSBAND. SHE EMAILED ME, CALLED ME, AND EVEN STALKED OUR FORMER FAMILY HOME. NOW SHE IS TAUNTING MY KIDS BY PHONE, AND EVEN GOT THE BALLS TO TELL MY DISABLED SON (AUTISM) THAT I OWE HER AN APOLOGY, BECAUSE I MADE HIS DAD MISERABLE AND SHE'S" A BETTER WOMAN THAN YOUR MOM WILL EVER BE." HE LIVES WITH DAD DUE TO HIS DISABILITIES, SHE CAME TO A BBQ AND SAID SHE'S GOING TO "ADOPT" HIM AND TAKE HIM AWAY FROM ME THAN RUN OFF WITH HIS DAD.

HER COMPANY COMMANDER HAS ALREADY VERBALLY CLIPPED HER HEELS, BUT SHE CONTINUES HER NASTY BEHAVIOR. WHERE DO I GO FROM THERE?

Sounds to me like a case for local police department if you are being harrased or threatened. As far as charges from UCMJ, that is up to their chain-of-command to pursue. Try writing to highest reasonable authority (squadron/battalion commander) and inform them of situation and seek their assistance.

Anyone can initiate charges under the UCMJ. You can do so by letter, sending a copy to her commanding officer and to the local inspector general, explicitly stating that the woman has violated the UCMJ and listing the pertinent information. By regulation, the command is required to then initiate at least an informal investigation. Whether or not they proceed with NJP (or even a court martial) depends on what the investigation turns up, as well as the CO's discretion. You could look up specific regulations on stalking, but that conduct would probably fall under Article 134 (the "general article") at any rate. If you just complain a command can simply ignore you. But if you are explicit in claiming a violation of the UCMJ and insisting that the command follow regulations(i.e. RCM 303 and related orders) and investigate the report --then they are well advised to do so, and usually will.

Thank you. I know the BN Commander sent my letter to the EEO Command to look into "sexual harassment" as a possible charge. Everything this woman did was for the specific purpose of gaining a sexual relationship with my than husband. Since I do have a previous no contact order that we have proof she broke I am hopeful that they will do more than clip her heels, I swear obsession can make others lives complete hell, and her target being my children even is worrisome to their counselors. I appreciate your information.
