Upgrade from OTH?


What is the name of your state (only U.S. law)? NC

I've been out of the USMC since 01. I received an ADSEP 3 months before my EAS and served my full term. I was NJPed for a positive urinalyses and received the ADSEP along with a few other unfair punishments.

I have tried to get the upgrade and was denied. The reason was drug use. After doing years of research I have come across many correlated studies that show persons with a Bi Polar disorder is more likely to abuse drugs. If this is the case, would my case have a better chance of getting over turned? It would seem like it would be some sort of discrimination if it wasn't looked at a second time. Any help or advise would be great.

This, along with every other piece of "advice" you have given in other threads today, is wrong. You can only get an upgrade if the original discharge was in error. Drug Use is always an RE-4 (or equivalent), and not upgradeable.

You can absolutely receive an upgrade to your category of discharge, if you can prove it was given unjustly or in error. The board of appeals does not have the authority to make any changes to your RE code. You have every right to appeal your case to the board but you will not get to far with your little story. You need to learn to accept the responsibility for actions and stop trying to find excuses for your bad decisions.

ts called advice. Learn the difference before sounding ignorant.
