Usmc breach of contract??What is the name of your state (only U.S. law)? CA Brief Description of Scenario: I was told when I signed my 5-year USMC contract for Data Systems 0600, back in 2005, that I was signing for 5 years solely based on a year-long MOS school training as my recruiter emphasized. As soon as I graduated Marine Combat Training (MCT) on 31 January, 2006 I was given orders to go to a completely different MOS (MAGTF Planning 0500) than what I signed for. After 3 years of personally investigating the matter I found out these following items: 1. Both the Data Systems (0600) and MAGTF Planning (0500) MOS fields do not warrant a 5-year contract because none of these MOS's have more than a 6-month MOS school. The Combat Camera field also has this dilemma. 2. Data Systems, MAGTF Planning, and Combat Camera MOS's had 4-year contracts that seemed to merge into 5-year contracts ending in 2004 and beginning in 2005. 3. A multitude of Marines within the Data Systems and MAGTF Planning MOS's were told, by their recruiters, that they were signing for 5 years because of school, when in fact, it was because of STOP-LOSS. A friend of mine from Harvard found this out for me. 4. The MAGTF Planning MOS Chief at Headquarters Marine Corps told me that some officials are discussing the possibility of putting these MOS's back to 4-year contracts because they do not warrant an extra year when the MAGTF Planning school is 5 weeks long and the Data Systems field does not have any school lengthier than 6 months. 6. Some Marines both in the MAGTF Planning MOS and the Data Systems MOS were completely screwed out of their guaranteed MOS's that they signed for in the first place. Thank you for taking the time to review what I've found. My local Congressman and his representative haven't done much in the past 8 months except try and clarify this case to officials in D.C. I am getting tired of sitting around for nothing. |
