USMCR Discharge questionWhat is the name of your state? NC.....Bear with the story if you could... In 1999 I was the USMCR, had been for quite some time and had less than a year to go. I started a new job, a very important one, and I missed two drill weekends..yes two. I received documentation in the mail that said I would be administratively discharged and reduced in rank unless I corrected the deficiencies. I called my command and explained the situation and that although my employer could not prevent me from drilling, they could make things relatively uncomfortable with me. I was speaking with the I&I staff and he asked me how long I had on my contract, I told him and he said that he could drop me into the IRR for the remainder of my contract no problem..he told me to come and turn my gear in when I could which I did (on a weekday which was a day off)..I never received another piece of information from them until Sept of 2000 when they sent me a bill for having paid too much into my SGLI...now my background is spotless..and I do mean that..the job I had was in L.E. and I recently left it to pursue contracting in the private sector. As I had only a DD214 from active duty (honorable) I requested my military record..and found out I had been discharged UOTH..I am retaining a lawyer to attempt to upgrade it, what do you think my chances of success are and how will this effect my ability to get a security clearance...and thanks for reading-- |

Can someone answer this for me?Dont know what that was about but it clearly didnt have anything to do with my question...can anybody give me some info? thanks |

And given what you had shared, that is posted, it is good that you are retaining Counsel because it sounds like a big can of worms that you will be dealing with! Good luck and do not give up! | If you've hired a civilian attorney, you should listen to him or her. Sounds to me like you need to get a package together for the NMCBCMR.

| Thank you all that have responded, I appreciate it..I am looking for an attorney now, there are alot out there trying to find a good one.. So from what I am gathering from the research I have done, this is a somewhat common occurence in the USMC? UOTH is a huge thing, usually given for significant misconduct...I am having a hard time wrapping my mind around how this came about.. |
