| Waiving rights of Solider/Sailor Relief Act What is the name of your state (only U.S. law)? Va
I'm currently in Korea and my wife decided 90 days into the tour that she hated being with me (her words). She sold our house, gave my dog away, took whatever she wanted out of the house, and put the rest in storage.
Needless to say, we're divorcing.
Our seperation has been in effect for 7 months, so we're eligable, and my lawyer says that the seperation agreemant becomes the decree. We both just sign an additional document saying we're divorced and that's that.
My lawyer reports that the STBX wants to go ahead and divorce now instead of waiting until I come home, which I'm fine with because I'd rather not have to go to court and see her anyway. I asked my lawyer if he can sign in my place and he says he can, but I need to waive my rights under SASRA. Is there a form to fill out or....? My lawyer told me to see JAG about it.
Further, my lawyer said that she won't be entitled to anything that isn't already listed in the seperation agreement. She waived her rights to support in exchange for 3K.
Thanks! |
