Bankruptcy...foreclosure...Truste... time


What is the name of your state? Maryland

This will take awhile sorry... Back in July my wife and I decided to refinance our current mortgage to not only pay the current one but also payoff our BK13 and pay some medical bills. We gave all of the paper work to our soon to be mortgage company that filed it. They stated when needed to get a court order to refi, ok go through that motion. The court orders the refi. truste does not object. Mean while our current mortgage falls behind due to paying medical bills. Then I call the new mort company about the refi. they state they are waiting on papers from truste. The new company know we are late on the current mortgage and do not seem worried. Now for the hard part.

We recieve a letter from the current mortgage holders lawyers stating that they have filed a motion to lift our "stay" so that they can foreclose. The new mortgage company has said that the truste will take another 10-14 days to process thier request. However they are still willing to work with us. The 14 days thing cuts it very close to the court date, with in a week. My lawyuer seems to think we should still try to do the refi.

The question then is the New Mortgage company pulling my chain and should I rely on this. Or should I file a motion to object to the current mortgage companies request and try to block the removal of "stay". We will be current or very close to being current when the court date happens. Will they play a role in the court decision. Help
