behind payments mortgage company refused paymentI live in Oklahoma. I got behind two payments on my mortgage. When I called to make one payment they refused payment unless I payed the full amount owed. Can they legally refuse payment. What can I do now? |

| Yep. Your failure to comply with the agreement you signed is a breach. They don't want to get into a position where they lose thier right to foreclose by accepting a partial payment. Quote:

| As was answered, yes they can refuse partial payment of the arrearage at this point. Ask the lender to set up a forbearance plan. They are going to want to get the full amount over a short period, so you will have to be able to pay full payments plus payoff the arrearage over the next several months. |

TrusteeThe reason they would not accept payment is because right when you default on the loan and a Notice of Default was recorded, most lenders hire a Trustee to handle the foreclosure proceedings. After a Trustee has been appointed, the previous lender cannot accept payment. It all has to be filtered through the Trustee service handling your case. You can find out the Trustee's name by referring to your Notice of Default. |
