being evicted from my house


What is the name of your state (only U.S. law)? arizona
just recieved a summons from my mortgage company ...have a court date on the 28th of may 09..
been trying to negotiate a loan modification with my loan company...was given an ultimatum on the 16th of april and was told house was gonna b sold on the 17th of april...all this was verbal only...Anyways yesterday i was served a summons saying the house was sold and i can attend the hearing on the 28th...
my question to anyone is...hw can they do that without legally sending me a notice through the mail...and secondly if i do get evicted will they come after me for the balance on the mortgage .. i only have one loan and its my primary residence..also can i still fight this case so i can still negotiate for a better rate on my loan or is it too late?

The notice of sale is mailed to you THREE MONTHS before the sale. Are you saying you didn't receive one back then? Twenty days before the sale, the notice is posted on the property. Are you saying that didn't happen?

If the house is sold you have nothing to renegotiate. If it were possible for you to obtain financing, you could redeem the property (if you do it pronto) but that's not likely possible.

Arizona has anti-deficiency statutes that cover most residential properties (single family or duplexes on less than 2.5 acres).

Hard to believe OP was completely clueless on the sale of the home.
