Can a homeowner file a lien against his own home to delay foreclosure?What is the name of your state (only U.S. law)? GA My brother in GA is unemployed and facing foreclosure soon. He says his lender completed some of the paperwork when he got his mortgage a few years ago, to help insure he would qualify. He believes he has a has a claim against them for what he says are illegal things they did. He needs a delay to get together some money for an attorney, and hopefully a job in that time. He is thinking of filing a lien against his own property for all the money and labor he's invested thinking that will delay the foreclosure. Can he do that, and what are the consequences? | Nothing filed AFTER the lis pendence will impact the status of title.

| Thanks for the reply. I thought the lis pendence was notice that there were pending claims on the title. So adding another lien would not change that. The idea was to further "cloud" the title with the lien and force the lender to take the matter to court thereby delaying the sale. Now that I think about it, all it would do is to create a subordinate lien which would have no effect, and not force it to court for a delay. Is my thinking right? |
