Can I be liable for my fiance's foreclosure?


I live in Colorado.

My fiance is currently going through foreclosure on a property. I am currently building a new home with a builder, which I will close on in June, before we get married. We are planning to get married in the early fall, but her foreclosure may not be completed by that time.

What I need to know is, can I become liable if the mortgage company takes her to court and gets a judgement? Would they be able to put a lien on the house that I will own? Is there any reason to delay getting married until her foreclosure is complete?

My response:

Since you're building a home, and able to obtain a mortgage, that tells me that you have a good profession and an education. Why, then, would you willingly marry someone beneath your status?

She's going to be a financial lead weight for years to come.

Thanks, but I'd appreciate responses to my original questions rather than going into why I am marrying a woman who, through circumstances beyond her control (medical related), was forced to foreclose on a property.

You
No, you and your property will not be liable for her debts. Just as long as you keep her poor, she won't be paying anything. But, as soon as she gets a job, or comes into money in some fashion, SWOOOOOOSH, it'll be gone.
