can my partner screw me


What is the name of your state? florida. me and another guy bought a house last year. we want to refi but becase of some issues im having with my ex wife i might not be able to. i didnt not kive at the town for 4 months but the other guy did. now hes saying i owe him money, when the rooms were rented out. well this past week through the grapevine ive come across some info that hes trying to get me off the loan without giving me a dime, not even the 10k i have invested. i know since im on the title tecknically he cant do anything without me but im worried he might know something i dont. he doesnt know i have any idea and i havent mentioned it. but i am worried about losing my money, i really dont care to make profit bec ause of the situation but i wont my investment back. do you all think im safe or should i take some steps to keep myself safe

If he should be able to get you off the mortgage without getting you off the ttle he is a fool. Barring paperwork to the contrary you would then own a portion of the property without the liability of paying a dime on the mortgage.

Having said that there are all kind o unscruplous people out there and he might just forge some paperwork and work with a lets say "talented" loan officer and magically make you disappear from the paperwork.

Run it by a real estate Atty or ask the other person what's going on.

Oh and with a competent appraiser you might find your 10K has been eaten alive when the boom went bust in many areas, depends on where the property is located.

so if they tried the appraser thing cant i ask for another appraisal with the company of my choice

I am not saying they have to "try" any appraisal mischief just that an honest appraisal nowadays can be far lower than the purchase price just because of what has and is happening in the real estate markets in some areas. So it depends on YOUR area and the price might still be right up there.

IF he is trying to do all this behind your back and legally then he will not be able to do it IF you do indeed have an interest in the property and are on the title.
