closing tomorrow....foreclosure? WTH???


What is the name of your state? Texas

Signed contract back in Feb.....have been told by lender we are approved and would like to close tomorrow. Utilities already turned on belongings are currently in the house (as per seller's approval) Found out the house we have been tyring to purchace for the last 3 months was foreclosed on 5/6/08 by bank. Is there anything we can do? Do we have any rights? Can we sue?Does this mean our contract is voided? I need help have to think of something fast! Any advice?

I need to find out who the lender was on a home I was trying to buy. The seller's were foreclosed on 2 days before we were suppose to close. Now I cant find out any information, and noone knows whats going on. I want this house and figure since Ive came this far (approved for the loan) I thought whoever foreclosed on it might want to sell it to me, since going through the seller is not an option anymore. Where do I start? Is there anything I can do? Should I keep trying or just give up?

You're in deep trouble. Are you saying it that the sheriff's sale already occurred?

First, I'm hoping any earnest moneys you have are in a trust account somewhere outside the reach of the seller. I'd first send a letter to wherever that is putting them on notice.

If the lender bought the house at the foreclosure sale, contact them and see if they are disposed to proceed to sell you the property.

You're probably going to need to get a lawyer involved otherwise.
