co-mingling funds?


What is the name of your state (only U.S. law)?

I live in Anne Arundel Maryland. My girlfriends grandfather recently refinanced his house for 110,000. The mortgage company cut him a check for 50 grand and they kept 50 grand for themselves. In exchange his payments were defferred for 12 months. They are going to apply their portion of the loan toward the principle after 6 months.

Can we demand that money back and start making loan payments asap?

Why don't you just make payments on your own starting now? Then when the deferrment is up, you'll have already applied that much more to the loan.

If GF is not on the mortgage, you will have a tough time getting the money out when it's in another living person's name.

Also, this is a double post.

Its not that I don't want to pay the loan, I can't grandpa got a 17% intrest rate and I can't afford the payment. We need that 50 grand to give grandpa money and fix the house.
