Question

Contract of Sale Foreclosure


What is the name of your state?undefinedWhat is the name of your state? New Mexico

Timeline:
1997--divorce 2000 divorce final owned two homes -- we each received one home in divorce--took children to greyhound station (left everything) went to Pennsylvania. (bad scene--my attorney in his pocket?)
2001--exactly two years later -- x ends up in prison -- he signs over his interest in the home he was awarded --I return to "save the farm". February 2003 Wells Fargo files foreclosure on his/now my house. (They took repair money/insurance check and refused to account for it (said it was lost--and got away with it -- also refused to account for a wire transfer for over $6,000) Long story -- couldn't afford an attorney -- legal aid out of the question...case too big ?Wells Fargo?
October 2002 signed Contract of Sale on home I lost while in PA. Occupancy began January 2003. In February 2003 had to file for disability. Another long story.
Currently in court. Was just served with Motion for Summary Judgement. I have no legal representation. I accepted the property "as is". The home had a bad roof. When I did the original walk through...men were refinishing the cealings. (I assumed the roof had been repaired...wouldn't you?)
First rain...the cealings began to leak and split. Year 2003 and beyond I never received a receipt for payment or a tax statement for year ending for interest paid. December 2004 received a letter giving me three days to vacate for non-payment of rent. As my disability grew worse, I did get behind, but not as much as they said. I requested an accounting from them. They said I would need to send in my receipts. I found some of my money order stubs, but not all... In contract of sale it is stated that the Mortgage holder will act as escrow agent. His lawyer, in deposition, asked me to show him where it states his responsibilities....of course it doesn't state anything. He knew I was disabled and would be able to get caught up contingent on my receipt of disibility benefits. (I am still waiting--what a country) I must save my home...I have no income...I have a personal care giver--I am on serious medication... Of course a lawyer is out of the question for me... any advice?
(Oh! When I took over the home I agreed that the deed wouldn't be filed until I paid the priniciple down to an agreed amount and the home had no water to it, gas, air conditioning, furnace, and was missing all fixtures. I have replaced and fixed all these, which has greatly increased the value of the home.)
