CT Foreclosure question -Please HELP ME!!!!


I went through a foreclosure last year on my condo and paid the total amount presented to me by the law office representing the mortgage company. It has now come to my attention that money I was paying towards the mortgage in 2005 has been paid to a corporate account because of some fees paid to the association (by the mortage co.) and now the mortage company is saying that they never included association and legal fees in the bottom line amount paid and that it needs to be paid. Becasue of these issues they want to foreclose again and I am furious that now in the 11th hour they are telling me of some 6000 dollars that need to be paid. How did this get overlooked for 10 months? Why am I finding out about it now?

Please someone help me. I am literally at my wits end and need to know if I have any rights here... They made a big error and now want me to pay for it. It doesn't all sit well with me...

I agree.

The stupidity of the foreclosers does not mean you don't have to pay your debts.

**A: and if the lender fails to calculate correctly or gather all bills, that does not waive your liability for same.

Yes, but...


I am not running from my responsibility.. My only problem is that they didn't tell me of this until now. The foreclosure was stopped in March '05. Why didn't anyone tell me of this until now? Plus, they used payments I made towards my mortgage to pay on this without giving me the decency of a heads up on what was going on so subsequently I was late on payments, hence getting me back into the same jam I was in before.
Like I said, something about all this just stinks to me!

**A: why do they need to tell you about HOA fees? When you bought the condo you bought into a project regulated by recorded CC&R's. You already agreed to pay the HOA fees by virtue of your ownership in the condo project. So YOU were the one responsible for asking about the HOA fees, not them telling you.

The recording of the public offering statement is considered public notice of condominium fees are due and payable in CT. Also condo associations in CT have the ability to elevate up to 6 months of late condo payments into "super lien" position, in front of the mortgage! Plus they can collect late fees and attorney's fees. They can even start foreclosures to collect their money. If this $6,000 is condo fees, late fees and attorneys fees, then you must pay them. Don't look to the lender to tell you that condo fees are due and in what amount. You need to get invloved with the association, go to the meetings, vote on the budget that set the condo fees etc...
