| Deed in Lieu or BK ? Georgia Property What is the name of your state (only U.S. law)? Georgia
We have our residence in MO, but own a house we use to live in and now rent out in GA. The whole thing was a mess. The appraiser who was on the preferred list by Wells Fargo inflated our appraisal. I say that because he did not include the foreclosure next door, nor did he list the neighborhood was not stable that was 4 years ago. Wells Fargo was suppose to do a desk review but because I worked as a receptionist at the brokers firm in GA the Operations Manager (brother in law to appraiser) called our Account Executive and got the desk review waived because the system was down at Wells. We were new to the area, knew nothing about the neighborhood, and I did not know what a desk review was, but I do have the "findings" from Wells fargo that shows they demaned it and then close without it. Anyhow, 1.5 years later we could not sell it for even close to what we paid and the markets were still doing fine at that time. We ended up having to rent it out. I have have contacted Wells to try a short sale, but the place will not sell! We have had it listed several times, and per Wells we needed to list it again before they would even review our case. It gets worse, my husband lost his job last week and can not find a new one in the car business. We are broke and can not afford to pay our mortgage as the rent does not cover the payment. We called Wells and the were not interested in talking to us at all about a deed in lieu. We are current by next month we will not be as we don't have the money period. We have smaller credit card debt but right now we have medical and dental issues that are running up the card too. I am working full time and we are trying to pay the other three bills we have the residence (no equity) and two cars that we also have no equity in. How do we get help in getting a deed in lieu, or should be let them foreclose? Will they try to make us make payments without any money? Or is BK the only results? Thanks so much. |
