Delinquent Mortgage Payments


What is the name of your state (only U.S. law)? New Jersey

My husband mortgaged a manufactured home for his mother to reside in. She is responsible for the mortgage and the lot rent, however the mortgage is now 2 months delinquent. The home is currently for sale, but what can we do in the interim if she continues not to pay the mortgage/ lot rent? Also, our family home is mortgaged under my name. Will the delinquency on his mortgage affect the mortgage currently in my name?

**A: this question is easy. What you can do is have him pay what he contracted to pay. He signed the mortgage so he is legally liable to pay for it.

**A: no, it should not unless things get worse.

delinquent mortgage payments


He acquired the mortgage under the understanding that his mother would be making the payments. Now that she is not, we cannot afford to pay for both her home and ours. What are our options?

Wrong. He got the loan - HE is responsible for the mortgage.

Mom is not responsible for the mortgage.
Mom will need to be evicted.

The courts can not enforce any so-called "understanding" between your son and his mommy. He's going to have to figure that out on his own. His only options are as stated, pay the mortgage and if necessary sell the property.
If he defaults on the mortgage his credit will be screwed, he'll lose the property, and the bank will come after him for anything that was deficient in what they got at the foreclosure over what they are owed.

There's the legal advice.

I don't have the answer, but I have found myself needing the advice of what to do with my past situation. I would advise to google "homeless prevention New Jersey" or better yet, include your city and state. An agency may be able to contact your mortgage company on your behalf and get a workable resolution. My quick search came up with this:

New Jersey Department of Community Affairs - Homelessness Prevention Program (609) 441-3045.
You could try your Department of Community Affairs which could get you in contact with your local homeless prevention agency.
