My wife and I found a home and proceeded to buy it. We chose a bank and had a loan setup, with good faith estimates, which does not bind the bank to any set numbers I know.
Here is the problem.
We were set to close on a tuesday at 3pm. I received a phone call 3 hours before the closing and was told my interest rate was going up and my closing cost would go up. I figure there has to be some more notification than that? So my banker says he can work some stuff out to get the additional closing cost covered by the bank and the builder of the home, which still did not remedy the interest rate going up.
So we decided to proceed. When we get to the closing the numbers are still not right. The title attorney says the numbers are all over the place (not accurate) My banker tries to weasle up some excuse. Regardless, I told the title attorney and the bank that we were not closing. My wife and I left without signing a single paper.
A few days later I am checking my online banking and I now have a mortage setup on my account, keep in mind we never closed. Is it legal for a bank to setup a mortgage in my name without us signing closing papers?
This has been a horrible experience and I fear it is only going to get worse.

| | | NO it is not legal. Call the Bank and tell them you want the info immediately removed and then make sure it is not listed on your 3 major credit reports. If it is send a nice written notice to the bank you will file suit if the info is not removed from the credit reports and it keep you from getting another loan elsewhere! Also inform the credit bureaus that it is false info. THANK YOU FOR WALKING. Sooooooooooooooo many don't then come here complaining about predatory lenders! |

OP does the mortgage show a balance? Or is it showing as a lender but with no balance or payment requirements?
