Escrow mix-up


What is the name of your state?Indiana
We have a mortgage with an escrow account to pay our homeowners insurance and property taxes. We were recently contacted by a title service stating that they mistakenly applied funds to our parcel number instead of their clients account. This mistake was missed by our bank and our property taxes, (all but $174 of the fall taxes) were paid by this title company. Now, they are trying to take us to small claims court over it. What action should we take? Shouldn't there be a tremendous surplus in our escrow account since the money we were putting in to pay our taxes wasn't used? The bank did give us an overage check, but it wasn't the amount that the title company paid. I have spoken to a rep at the bank, and she said we could pay the title company out of our escrow account, but how do we make sure the bank doesn't somehow rip us off ? I know one thing, after it is all said and done, we are going to refinance with another company, and we will not have another escrow account. I would appreciate any legal advice you can give us.

Sounds like the servicer is trying to make them cover costs for their mistake.

Who is the servicer?
