Eviction Help, Please.


I Live in Michigan. We were foreclosed on in January of 2005. Our redemption period will be up on January 27, 2006. We are trying to continue to rent from HUD, (our loan was FHA), when they take posession of the home. We have been told by our mortgage companies attorney's that if HUD denies our continued occupancy request that we will be evicted. 1. Does this eviction work like one would with a landlord? 2. They say we will receive a notice from them, do they have to file a court eviction, or just send a letter? 3. I am disabled and have a disabled child, (she is 12 and both mentally and physically disabled), can they just throw us out without working with us? Thank you very much for your time and consideration! We tried very hard to keep the property, the redemption terms just ended up being too high for us to viably handle. When the title passes to the lender, your status changes form owner to renter. The lender is required to convey a vacant property to HUD unless an occupied conveyance is approved. If an occupied conveyance is denied, they will evict/eject you in accordance with state law. (Proper notice etc) If an occupied conveyance is approved, HUD will take title subject to your occupancy. An occupied conveyance is a short term solution and is not meant to be a long term rental. It sounds like you need to start looking for an affordable rent. Contact a local housing counseling agency. Thank you very much for your quick reply! I wasn't planning on hearing from anyone so soon! Your answer helps me very much. We are looking for a rental. Affordable is the only problem...LOL. But, I know we will get there! At least I understand the eviction part better now. Thank you as well for the number! I will use it, today! My doctor is trying to help us with the HUD end for now, so that we can hopefully rent here for a little while, until weather clears up some and give us time to pack and all. i'm in kansas and wish to know what proper notice of an eviction is.
i was handed eviction papers on last friday saying i have to be out by this coming friday (so 1 week) i am in the middle of moving but there is NO way i will be able to be moved out by friday. i work 45 hours a week and am moving about 30 miles away. i've been making 1-2 trips a day after work to move stuff.
