Excess proceeds from foreclosure sale

I am currently paying off my debt in a Chapter 13 bankruptcy. After we started the bankruptcy proceeding our home was sold in foreclosure for $80,000. Our mortgage company was owed $53,000. We also had a second mortgage. I believe we owed them $50,000. I recently was contacted by a company that said it can proably collect the excess for us (they get 35%). This company told me that the second mortgage company proably won't bother laying claim to the money, because they have already written us off as a loss. Is this true? Can I really get this money? And if so, can I do it without this company by contacting the court?

No one should be allowed to leave the house until they sign a statement acknowledging that, "If it sounds too good to be true, then it is."

Not an idiot...haven't signed anything


I only said I got the offer. It definitely sounds to good to be true. The company claims will loose nothing if they don't recover any money. Is this standard? What money can they take if I am not paying them?

Did you ever find out how to get the money or if you could get the money and if so, how did you do it. I have a similar issue. My house was foreclosed and I was sent a letter from the attorney's office involved that stated they were sending me the information if I wanted to file a claim with the court but that they would have nothing to do with it. I called the court and they said I would probably need to get an attorney. I was hoping that someone knew of a form that I could just fill out with the appropriate information and send it to the court myself without having to have an attorney.
