FHA/Hud Refund Question


What is the name of your state? VA

I refinanced my Oct 2002 mortgage in Nov 2004 with a new lender and paid off the existing loan. Received letter from old mortgage company that because my loan was FHA/HUD insured I was due a refund from HUD. The letter stated that if I did not receive an application or refund check from HUD within 45 days of payoff to contact HUD.
I contacted HUD and they stated that my loan was never insured because my then mortgage co. never completed the paper work and the premium ($3,379.50 from 10/31/04 settlement) was sent back to the mortgage co on 6/18/04. I contacted the mortgage co and they said that they will do some research and will contact me. I also reminded them that I have been paying a monthly premium of $95 into my escrow account for over 2 years (addt''nl $2,280.00). I have reviewed my escrow activity and the payment to HUD was deducted from the balance each month (HUD stated those pymnts were also sent back). My questions : has anyone ever heard of this and do I have to abide by mortgage co terms for them to complete the research, after all it is my money and HUD has confirmed that the funds where sent back to the mortgage company?

OHHHHH! Please tell me you have Washington Mutual - if so I am dealing with similar issue right now with an attorney! 3491 out of pocket and 108 monthly for about 18 months. They also did not file the paperwork when we refinanced with them 5/2004. If you have WAMU and our experiences are similar - I believe we have a possible suit. Possibly treble damages + attorney fees. Please wrie back asap and let me know if it was wAMU or if WAMU serviced your loan.
