Forced escrow account on mtg now payments not recorded.

What is the name of your state? Alabama
Had the mtg since 2005. Homeowner's ins and taxes were accidentally left out by the mtg company at closing. We have been paying them ourselves since. Mtg company wanted proof of ins. last year (2007). We faxed it 6 times and they claimed to have never received any. We sent it certified letter, which they signed for, and they claim not to have received this either. Finally had to get attorney from Alfa insurance to call them and that finally worked. In the mean time, they were posting our regurlar mtg pmts to an escrow acct so it is showing 4 months behind. They can't seem to figure this out or fix it. They want us to send them a large pmt and they will refund when they figure it out. I will not do this. They also call us once a week, which I have numerously told them to stop. They ask for payment or it will be reported to credit agency.
What can I do? I am ready to sue them for harassment! Help please. Gina
