Foreclosure ?


What is the name of your state? AZ

I have skimmed through most of the threads and didn't find exactly an answer to my question - although all I've read is good information.

Our house is in Foreclosure. We've received notice from the attorney's office and the sale date is set for July 13, 2007. Just yesterday, American Servicing called me wanting to know if I had $9500.00 to cover our past dues. I explained to her that my husband is waiting on funds from his 401K to cover them. (American Svcg has been constantly calling). In yesterday's mail the monies arrived.
My question is can we pay the amount directly to the mortgage company or do we have to pay the attorney fees as well? It just seems odd that the mtg co keeps calling knowing they have an attorney. Thank you for your inputWhat is the name of your state?

Call the Attys office and ask them to whom the payment should be made. YES, if Atty fees have been added to the total amount due they will need to be paid unless you can negotiate them down. Don't wait on negotiating fees while you lose the home.

I am not clear, who is this American Servicing? And if you do not know I certainly would not be sending them money.

American Servicing is our mortgage company. I was thinking if we did pay the mortgage company their money (after I take your advice and contact the attorney's office), then maybe we could make "payments" to the attorney's.
Long story short - my husband was in a motorcycle accident Dec 3, 2006 and hasn't been back to work since. He's an engineer for Union Pacific RR so he gets a little supplement while he's off of work but it's not enough to cover the bills. Even though I work full time it also isn't much. His 401K cut a check for the total amount of the reinstatement so there is an additional $4000. I say "additional" because the monies due to the mtg co are $9500.
Plus my husband still hasn't been released for work and he needs to go in for more surgery (collar-bone), so we are unclear just how much longer he'll be out. With the "additional" money we could make July's mortgage payment and catch up on some other bills. Would this be wise?
