Hi there, I hired a loan modifier in Oct. 2008 to modify my mortgage, and now it is almost may of 2009 and I don't believe he is doing his job. I have just been served foreclosure papers and I do not know what to do. I paid this guy $2,000 and I do not want to loose my house can you help me? |

Some, however, may agree to a forbearance if the buyer offers to bring a chunk of cash toward their arrearage, or comes up with an acceptable plan to get caught up and on track. How far might that 2k have gone toward your delinquency?
Are you the sole occupant? Did you ever consider getting a roommate for now to help cut your housing cost?

| | | Attorney not needed An attorney is NOT needed, although a good one might be worth it, but they are VERY hard to come by, as most just do a little to slow the process rather than actually fight it. For starters, is the 20 days up? Did you answer that complaint? Do they have the note & mortgage, or are they just claiming it was lost, stolen, or destroyed - AND which is it, it CANNOT be all three, is there an insurance claim, police report etc., to substantiate thier claim. They MUST produce the original note & mortgage to foreclosure, or produce PROOF, not just claims of how and why they do not have the original in order to proceed. If you can, go to Palm Beach County, and research the cases of Joseph Lents, as he has been fighting foreclosure from TWO banks on the SAME mortgage for over sever (YES SEVEN - 7) years on multi-million dollar home. The main basis for his fight - produce the ORIGINAL mortgage and note, which neither bank can do, so guess what, he stays put, and so can you! Try and send me a message and I will gladly put you in touch with lots of resources to fight the foreclosure, there are some great resources as it can be done, as I have been fighting for 16 months without an attorney - but it is difficult to navigate the legal system, so be ready for a difficult learning curve! | |
