What is the name of your state? colorado
We are 5 months behind on our mortgage and our sale date is in 15 days. We have filed bk does the mortgage company have to stop foreclosure on a chapter 13. |

| | | When did you file for BK13. If it was after they had filed for foreclosure, then all legal actions taken against your home and land are stopped by the BK court. That is the benifit of filing for BK13. You will then have your meeting of the creditors which you need to attend. This is when you will be asked questions by your trustee (who oversees all of the transactions of the Chpt 13). The plan is then judge upon by the court and ratified. So to answer your question NO the foreclosure sale is stopped by you filing for Chapter 13. My wife and I went through this a year and a holf ago. | |
