Foreclosure HELP


What is the name of your state? CALIFORNIA

PLEASE HELP

I am trying to find out if I have any recourse in my foreclosure proceedings. Specifically, does the clock reset if the bank accepts payments.

Here is the situation. I fell behind on my mortgage. I was notified that I was in 'pre' foreclosure being that I was 3 months behind. I made a payment immediately ( 1 month ) so I assumed that made me 2 months behind and that it would stop the process. Then I recieved a REIT letter stating I was in 'foreclosure' about 2 weeks later. I called the bank and told them I would make the 2 past due payments to bring the account current. They said it would be fine and when they recieved the check I would be current. As it turns out. They sent the check back and said they could not accept the payment since I was in foreclosure and that I needed to remit the entire amount due which included Attorneys fees, penalties, and other filing costs. In short, it was a lot more money to get out of this mess.

Question: Does the payment I made - accepted and cashed - do anything to reset the clock or can the bank proceed with foreclosure on the same time line??
