Foreclosure Issue.


What is the name of your state (only U.S. law)? Idaho

Ok, maybe someone can help. I have a mulit-faceted question. My new wife's ex husband allowed his house go into foreclosure, we contacted the bank and made arrangments to take the mortgage over since her name is still on the mortgage. His brother states we have no rights to take over the house because he was awarded it in the divorce, but, in the divorce he was bound to refinance, or sell the house with-in 6 months which did not happen. Do we have the right to move in and take over ?

What she means is that no one can tell what a court would decide on such a matter without substantial work in research. That is impossible without all the facts. See an attorney and get his opinion, the fourum will not be able to help you.
