foreclosure laws and optionsWhat is the name of your state?What is the name of your state? NV Can a bank foreclose on a property before it is 60 days past due? Last month, the bank held a regular monthly payment instead of posting it to my account. They said they could do this because they had sent a certified letter to me when my account was 32 days past due, demanding the account with late fees be brought currrent by a certain date or face foeclosure. In the past, as long as I kept it under a specified number of days past due, it did not go to this point. If they had not held my payment, my account would have shown 55 days past due at the time they foreclosed. Instead, it showed 85 days. Can I fight the additional fees for the foreclosure? I've set up forbearance payments to catch up on the 2 payments that I am behind, but I don't want these other fees. Are they legally able to hold a payment and make the account appear more late so they can go ahead and foreclose? Thanks |

Yes they CAN demand you catch up entirely and not accept a payment until you can pay the entire amount due. Depends on how far the foreclosure got and the fees associated. Do you know that these fees have been added sounds like they are allowing you to catch up instead of go to foreclosure. |
