Foreclosure, Post bankruptcy


What is the name of your state? Tn
My wife and I filed bankruptcy effective(final discharge) date was Jan of this year. She is not on the first or the second mortgage, but is on the third with me. Our second and third mortgages are currently up to date, but my first is now 5 months behind and scheduled to foreclose on Nov. 2.

Chapter 7 was filed on all three mortgages, but the first mortgage which is the one behind by 5 months and desirers foreclosure was not reaffirmed in the bankruptcy.

The first mortgage company desires about $5,000.00, will accept one half now and one half next month to catch up. The balance/pay off is about $85,000.00. The second mortagage balance/pay off is about $19,000.00. The third mortgage balance/pay off is about 12,000.00. These total to about $116.000.00 plus attorney fees.

The purchase price of the home was $103,000.00 3 years ago. We have had the house just under 3 years and it's in reasonable condition.

I have been on disability for 9 months getting 60% of my income per month. My wife is employed as a nusre and makes about $40,000.00 a year. We made all payments on time until we began to get behind with my redused income and can not afford the current payments.

The first mortgage company payments have went from $600.00 a month to $900.00 per month in less than 3 years (variable rate).

Can they foreclose with the second and third current, or will they or the buyer have to pay the second and third loans off if foreclosed?What is the name of your state?
