foreclosure stopped


What is the name of your state?Ohio
My husband and I have a property that is two family that we filed in bankruptcy two years ago. We have recently found out that the property was not foreclosed on and the mortgage company says the property is still our responsibility. I never received a letter from the mortgage company saying the sheriff sale would be stopped along with the foreclosure process. We have no financial obligation to the mortgage company that was discharged in our bankruptcy. Can the mortgage company do this? We are in the process of getting a new lawyer because the lawyer that filed for us is not calling us or not doing anything to help us. To top it off the City wants to demolish the property and last week the property caught on fire. Not a whole lot a damage. It has been secured. What do we do now?? I am so confused. We have all these questions and nobody has any answers. If they demolish the property we have to pay half plus the land is still going to be in our name. Please help!!

Have you read through your BK papers or are you just relying on what you think to be true? IF indeed the house is included in the BK have you sent out a copy to the Mortgage Co. CRRR (certified return receipt requested)? When speaking to the Mortgage Co. and telling them it was included in the BK what do they say?

Might want to pay another Atty a few hundred to read over your documentation or go sit in the front office of the Atty you paid to file the BK until they answer your questions.

We have read thru our papers and as far as we know everything is in order. We have our discharge papers and an order of relief from the automatic stay. We filed ch. 7 everything else went fine. The mortgage co. knows that we have no financial obligation, but refuse to take the property back over. We are in the process of a new atty but we know have thirty days before the City wants to demolish the house. Do we let them demolish it would that end alot of this chaos?? I just wanted to get some feedback since we have not got any answers. Nobody has dealt with this situation before. Also, the mortgage co. says it could be several reasons why they stopped the foreclosure. One is the payment was 180 days past due or that the area is a low market value. Thanks for responding
