What is the name of your state? Florida

What type of information is the attorney looking for when they say that one has to respond to the summons letter in writing within 20 days? It does not specify exactly what type of information they are looking for.

If the individual being served does not want the home anymore and is willing to let the home go into foreclosure, is it wise to put that in the responding letter? Or is it better not to put that info in the letter?

Thank You

Whether you want the home or not is immaterial. The bank wants their money.
If you don't mind your credit being trashed and potentially a deficiency judgment being entered against you for what you owe above the foreclosure sale amount, then tell them to kiss off. If you want to try to sell the house, get caught up on payments, or otherwise prevent the foreclosure, then you need to talk to them.

Call the RE collections dept and see if they will accept a Deed in Lieu of Forcelosure. Many REO Depts. will consider this to cut their losses. The advantage to you is avoidance of a FC on your record.

THe other option is to call them and ask if they have any RE brokers they work with who sell their REOs and if they will consider a short sale if THEIR trusted broker lists and sells the place now and ends up short. of equity to put a deal together. Many lendsers would rather accept a short sale than have a FC, so will work with you IF you make a good faith effort to sell it now.
