Foreclosure w/ no notice of default


California

Can a lender foreclose on my property without notifing me on the amount they claim I owe? I received a summons for a judical foreclosure on a small loan that I think was paid off a long time ago but I never received a notice of default.What is the name of your state?

They notified you, but, it could be that the notification was several years ago. Do you have a release of the lein?

And why do you think that the loan was paid off? Find out for sure and provide the real facts.

It's undisputed that there is no notice of default


First..... thanks for the replies

It's undisputed that there was never a notice of default sent, served, filed or recorded . They claim to not even know how much we owe. My question is if a NOD is a requirement prior to a foreclosure?

No, I can't find such a law. Look at your mortgage documents to see what they say. Also, did you receive a release of lein?

He said that this is a judicial foreclosure. You posted a link for non-judicial foreclosures.
