Foreclousure


I believe that I was forecloused illegally. What are the laws in the state of Michigan? I made a payment to the mortgage company which they accepted.
Also I lost my son husband my motherand fathter can I get some help. I am in Chapter 13 to stop the sale. I need help quick

**A: what you believe and what the law actually allows are 2 different things. Read your mortgage and note documents. In those documents that you signed, there are clauses with respect to remedies due to default.

**A: filing BK only stops the sale temorarily. Once the lender files a motion for relief and the court grants it, the foreclosure moves on.

It matters if you had a hardship...


Missouri

It does matter if you have had a hardship. The loss of family members can make a difference to your lender if professionally negotiated through Loss Mitigation. If you can now make you mortgage payments again Loss Mitigation can help. Has your sale date been set? You must act quickley to save your home. Please respond if you need more information.

I don’t know Michigan law, but I do know in some states that once your mortgage is accelerated, the bank can legally take your payments and still keep your mortgage accelerated and due in full. Right , wrong or indifferent, its legal.
