Former Plaintiff That Sued Landlord Now Defendant in Foreclosure??


What is the name of your state? WI

I will try to keep this brief and make a long story short. Back in November I moved out of my former apartment and did not receive most of my security deposit back. Although I had a copy of my original lease (3 years prior) that stated what I had paid the landlord, they still would not return it, although the apt. was left immaculate with no damages. I sued in Small Claims Court, got a judgment for twice the damages, then proceeded to file a garnishment on their bank account and basically, I got all my money, plus court costs, etc. About early June I received a call from a property mgr. affiliated with them that wanted me to provide a letter that this judgment was satisfied (it was) which I did, had it notarized, and sent to him to file with the Court. I don't think that ever happened. Meanwhile, I am served with a huge (2 reams worth) box of papers from a large local law firm that my former apt. complex is being foreclosed on, and I am listed as one of the defendents (probably I'm thinking, because I filed a lien on their property prior to garnishing them). I called this law firm, but because they represent the plaintiff, they really couldn't tell me if I needed to do anything. Can someone tell me if I'm only listed as a defendent because I'm a lienholder and also can I basically just not respond because I DID get my money and I'm satisfied. I don't know what my responsibility is to have the lien released, but I did save a copy of the letter I sent in June to try to do that. I'm really not a party to the foreclosure in any way, other than, as I said, having that lien placed on their property prior to receiving my security deposit back. Thanks for any advice!

Most jurisdictions require the forecloser to NOTIFY all the lien holders that the foreclosure is happening so they can take action to protect their interest. I suspect from tall that paper that there are quite a few people with liens or security interest in the property.

Did you read the first part of the paper (after all the names)? Is it a foreclosure?

Foreclosure Action Against Former Landlord--I'm Now a Defendant


Yes, this is definitely a foreclosure action against my former landlord, as well as a number of other properties they must be affiliated with.

I am not the only defendant listed--there are a number of others--mostly looking all like lienholders against the properties ... i.e., paint company, landscape company, asphalt company, etc., and finally me.

If they are just notifying me, do I need to respond to the court in any way?

My suit was only for $673.00 ... obviously I do not want to have to retain an attorney to get my name off of this unless there is some reason I have to.
