Garnish Wages or Lein on Current Home?


South Carolina...
Hello. I own a mobile home and have been trying to sell it for the past 2 years. I have been trying to work with my lender and keeping them updated on the progress of the sale of the home. At this point, I am now 2 months behind on paying the mortgage payment and they want to repo the home. I am at the end of my rope and told them to just come and take it back. They threatened to garnish my husbands wages in order to pay for the home. Now, can they do that legally or can they just put a lein on the second home, my primary home, instead? Please let me know. Thank you so much.

More information is needed -- is your husband on title or the loan. Was the mobile home bought during or before the marriage? Do you work? Do you two have a joint bank account?

Yes my husband is on the loan. He bought the house prior to the marriage. I do not work, just my husband. And we do have a joint bank account.

Do I have a choice on whether or not to have his wages garnished or place a lein on my current home? Or do they do whatever they want to?

**A: you do not get to pick and choose. It is solely up to the creditor what steps they employ to collect. And secured mortgage creditors have more power.

Well, first of all, I have a very young child at home that I care for. It makes more sense for me to stay home with her instead of using my entire check to pay for daycare. We can afford everything accept for the mobile home in which will not sell because of the age of the home. Thank you for your comment.
